6Prosecutions against Crown organisations

  1. A Crown organisation may be prosecuted (by the bringing of proceedings in the manner provided for in the Criminal Procedure Act 2011) for any of the following offences:

  2. an offence against the Building Act 2004:
    1. an offence under the Health and Safety at Work Act 2015:
      1. an offence against the Resource Management Act 1991:
        1. an offence against the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012:
          1. an offence against Part 3 of the Children’s Act 2014:
            1. an offence against the Water Services Act 2021.
              1. This section does not affect any liability of a Crown organisation that arises independently of this section to prosecution for an offence.
