Illustration for Constitution Act 1986

To be a Minister of the Crown, you must be a member of Parliament. You can only be appointed to this role if you are already a member of Parliament. If you are not a member of Parliament, there are some exceptions that allow you to be appointed as a Minister of the Crown.

If you were a candidate in the previous general election, you can be appointed as a Minister of the Crown, but you must become a member of Parliament within 40 days or you will have to leave the role. You can find more information about this by looking at s 9. If you are already a Minister of the Crown and a member of Parliament, but you stop being a member of Parliament, you can still be a Minister of the Crown for 28 more days.
