If you want to get a certificate, you must apply to the Registrar. The Registrar is a person who works at the District Court in Auckland or another office. You can find out which offices are accepted by looking at the regulations made under this Act.

You need to fill out a form and pay a fee to apply for a certificate. The form will ask for some information about you, like your name, date of birth, and address. You might also need to give a photocopy of your identification, like a passport or driver licence, and some recent photos of yourself.

The Registrar will give you a certificate if you pay the fee, fill out the form correctly, and are 18 years or older. You also need to make sure you are not disqualified from holding a certificate, or if you are, you need to have been granted a waiver. You can find out more about disqualification and waivers by looking at section 36 and section 37.

If your application is refused, the Registrar will tell you why and give you information about how to apply for a waiver. Every certificate has a photo of the holder on it and is in a special form. The Registrar will send you the certificate if your application is accepted.

35Application for, and grant of, certificates

  1. An applicant for a certificate must apply to the Registrar.

  2. In this Part, Registrar means the Registrar of the District Court at Auckland, or the Registrar of any other office of the District Court identified in regulations made under this Act as the, or a, Registrar who may accept applications under this section.

  3. The application must be in the prescribed form and be accompanied by the prescribed fee.

  4. The application may require the applicant to provide no more than the following:

  5. the applicant's full name, date of birth, and gender:
    1. any other names by which the applicant is, or ever has been, known:
      1. the address to which the applicant wishes any certificate and related correspondence to be sent:
        1. a photocopy of any form of official identification that contains a photograph of the applicant, such as a passport or driver licence, that is authenticated in the prescribed manner:
          1. 1 or more recent photographs of the applicant that comply with the prescribed requirements and are authenticated in the prescribed manner:
            1. if an order has been made under section 37, a copy of the order.
              1. The Registrar must issue a certificate to an applicant if—

              2. the applicant pays the prescribed fee, supplies a properly completed application form, and attaches the required photocopy and photographs; and
                1. the applicant is aged 18 years or older; and
                  1. the applicant is either—
                    1. not disqualified under section 36 from holding a certificate; or
                      1. is disqualified, but has been granted a waiver of disqualification under section 37 and the waiver has not been cancelled.
                      2. Every certificate must be in the prescribed form and must contain a photograph of the holder.

                      3. If a certificate is refused, the Registrar must notify the applicant in writing, with reasons, and give information about how to apply for a waiver of disqualification under section 37.
