If you are part of a Royal commission that started before this Act began, this Act does not apply to you. You will still follow the rules of the Commissions of Inquiry Act 1908. This is because the Commissions of Inquiry Act 1908 continues to apply to certain commissions and entities.

The Commissions of Inquiry Act 1908 applies to any commission of inquiry or Royal commission that was appointed under that Act and has not finished its work. It also applies to any entity that gets its powers from the Commissions of Inquiry Act 1908, including those listed in Schedule 1. You can find more information about this in the Commissions of Inquiry Act 1908.

You will keep following the Commissions of Inquiry Act 1908 if you are part of an entity that was established under an enactment that existed before this Act started. This includes enactments that have been modified or replaced, as long as they correspond to an enactment that existed before this Act began. The Commissions of Inquiry Act 1908 will still apply to you in these situations.

38Transitional provision

  1. This Act does not apply to a Royal commission that has not completed its functions and obligations before the commencement of this Act.

  2. The Commissions of Inquiry Act 1908 continues to apply to—

  3. any commission of inquiry or Royal commission appointed under that Act that has not completed its functions and obligations before the commencement of this Act; and
    1. any entity that is or may be established under an enactment that is, or that (with or without modification) corresponds to or replaces, an enactment enacted before the commencement of this Act, including those listed in Schedule 1, and that derives powers from the Commissions of Inquiry Act 1908.
