Illustration for Judicial Conduct Commissioner and Judicial Conduct Panel Act 2004

The Deputy Commissioner helps the Commissioner with certain complaints. You need to know the Deputy Commissioner can only deal with complaints when the Commissioner has a conflict of interest or is away. The Deputy Commissioner has the power to make decisions about complaints. The Deputy Commissioner can decide if they have a conflict of interest in a complaint. If they do, they must not deal with the complaint and send it to the Head of Bench. The Deputy Commissioner can send the complaint to the Commissioner instead if they think the Commissioner can deal with it soon. The Deputy Commissioner has all the power they need to do their job. If the Deputy Commissioner makes a decision or uses their power, it is assumed they have the authority to do so unless proven otherwise.
