When you read this Act, some words have special meanings. An associate coroner is a person who holds office as an associate coroner under the Coroners Act 2006. A complaint about a Judge is when someone complains about a Judge's conduct. You will see many other special words in this Act. A coroner is a person who holds a special office under the Coroners Act 2006. A Deputy Commissioner is a Deputy Judicial Conduct Commissioner appointed under section 8A. A District Court Judge includes a Judge who holds office as a coroner. The Head of Bench is the person in charge of a court, like the Chief Justice or the Chief District Court Judge. A Judge is a person who makes decisions in a court, like a Supreme Court Judge or a District Court Judge. A Judicial Conduct Commissioner is a person appointed under section 7. A Judicial Conduct Panel is a group of people appointed under section 21(1) to deal with complaints about Judges.

5Interpretation

  1. In this Act, unless the context otherwise requires,—

    associate coroner means a person who holds office as an associate coroner under the Coroners Act 2006

      complaint or complaint about a Judge

      1. means a complaint under section 11 about the conduct of a Judge; and
        1. includes—
          1. a referral made under section 12(2) by the Attorney-General; and
            1. a complaint initiated under section 12(3) by the Commissioner

            coroner means a person who is not a District Court Judge, but holds office as the chief coroner, deputy chief coroner, or acting chief coroner, or as a coroner or relief coroner, under the Coroners Act 2006

              Deputy Commissioner means a Deputy Judicial Conduct Commissioner appointed under section 8A

                District Court Judge includes a District Court Judge who—

                1. holds office as the chief coroner or acting chief coroner, or as a relief coroner, under the Coroners Act 2006, or is (under section 22(a) of the District Court Act 2016) a coroner by virtue of holding office as a District Court Judge; and
                  1. is exercising the judicial authority conferred on a coroner by the Coroners Act 2006

                    Head of Bench means,—

                    1. in relation to the Supreme Court, the Chief Justice:
                      1. in relation to the Court of Appeal, the President of the Court of Appeal:
                        1. in relation to the High Court, the Chief High Court Judge:
                          1. in relation to the Employment Court, the Chief Judge of the Employment Court:
                            1. in relation to the Court Martial, the Judge Advocate General:
                              1. in relation to the Court Martial Appeal Court, the Chief High Court Judge:
                                1. in relation to the Summary Appeal Court of New Zealand, the Judge Advocate General:
                                  1. in relation to the District Court, the Chief District Court Judge:
                                    1. in relation to the Environment Court, the Chief Environment Court Judge:
                                      1. in relation to the Maori Land Court, the Chief Judge of the Maori Land Court:
                                        1. in relation to a coroner or an associate coroner, the chief coroner:
                                          1. in relation to a Family Court Associate, the Principal Family Court Judge

                                            Judge

                                            1. means—
                                              1. a Judge of the Supreme Court; or
                                                1. a Judge of the Court of Appeal; or
                                                  1. a Judge or an Associate Judge of the High Court; or
                                                    1. a Judge of the Employment Court; or
                                                      1. a Judge of the Court Martial; or
                                                        1. a Judge of the Court Martial Appeal Court; or
                                                          1. a District Court Judge; or
                                                            1. a Judge of the Environment Court; or
                                                              1. a Judge of the Maori Land Court; or
                                                                1. a coroner or an associate coroner; or
                                                                  1. a Family Court Associate; and
                                                                  2. includes a person who holds office as an acting Judge, or an acting Associate Judge; but
                                                                    1. does not include a retired Judge or a former Judge

                                                                      Judicial Conduct Commissioner or Commissioner

                                                                      1. means a Judicial Conduct Commissioner appointed under section 7; and
                                                                        1. in sections 11 to 20 and 34, and clauses 7, 9, and 10 of Schedule 2, includes a Deputy Judicial Conduct Commissioner appointed under section 8A and carrying out his or her function under section 8B

                                                                          Judicial Conduct Panel or Panel means a Judicial Conduct Panel appointed under section 21(1).
