79: Transitional provision for permissions, etc, under Fisheries Act 1996

If you have a permission under the Fisheries Act 1983 or the Fisheries Act 1996, it keeps working as it was before. You can find the rules for these permissions in section 28Z(9) of the Fisheries Act 1983 or section 57(3) of the Fisheries Act 1996. These permissions are treated like consents under the Overseas Investment Act 2005.

You get these permissions if they were already in place before section 73 started, or if they were granted after that started because of section 77(2). The conditions that come with these permissions also keep working as they were before.

Some rules from the past still apply to these permissions, like regulation 14(2) of the Regulations, which was in place before section 76 started.

79Transitional provision for permissions, etc, under Fisheries Act 1996

  1. This section applies to permissions granted under section 28Z(9) of the Fisheries Act 1983 or under section 57(3) of the Fisheries Act 1996, and conditions of those permissions, that are in effect immediately before the commencement of section 73 or that are granted after that commencement by virtue of section 77(2).

  2. Those permissions and conditions must be treated as if they were consents granted and conditions applied under this Act.

  3. However, regulation 14(2) of the Regulations, as in force immediately before the commencement of section 76, continues to apply to those permissions and conditions of those permissions.
