Overseas Investment Act 2005

Consent and conditions regime - Enforcement - Offences

45: Offence of failing to comply with notice, requirement, or condition

You could also call this:

"Breaking the Overseas Investment Act 2005 rules can lead to a big fine if you don't follow them without a good reason."

If you do not follow the Overseas Investment Act 2005 or its regulations without a good reason, you commit an offence. You also commit an offence if you do not follow a notice, requirement, or condition given or imposed under this Act or its regulations. This means you must comply with what the Act or regulations say, or with any notices or conditions you are given.

If you commit this offence, you can be fined up to $100,000 when you are convicted. The rules about this offence can be found in the Overseas Investment Act 2005, which is a law that applies to you. You can find more information about changes to this law on the New Zealand legislation website, where the Criminal Procedure Act 2011 made some amendments.

You must make sure you understand and follow the rules in the Overseas Investment Act 2005 to avoid committing an offence and facing a fine.
