You can't work as an auctioneer unless you're registered under this law. This means you can't charge a fee or take a share of the money from selling things at auctions as your job, unless you're registered.

There are a few exceptions to this rule. If you're a real estate agent, there are some cases where you can do auctions without being registered as an auctioneer. The same goes for some motor vehicle sales. There might be other exceptions in other laws too.

When we say "carrying on business as an auctioneer", we mean someone who, as part of their job, charges money or takes a share of the auction sales. This doesn't include people who work for a registered auctioneer as an employee or helper.

5Registration of person carrying on business as auctioneer

  1. A person must not carry on business as an auctioneer unless the person is registered under this Act as a registered auctioneer.

  2. Subsection (1) is subject to the exceptions provided in—

  3. sections 48 and 49 of the Real Estate Agents Act 2008; and
    1. section 141 of the Motor Vehicle Sales Act 2003; and
      1. any other enactment.
        1. A person carries on business as an auctioneer if the person, in trade, charges a fee or commission for, or requires the payment of any part of the proceeds of, a sale by auction, other than as an employee or agent of a registered auctioneer.
