26: Application of Act to existing licence holders and others

“Rules for existing auctioneers when the new law starts”

When the new Auctioneers Act 2013 starts, some people will automatically be considered registered auctioneers. This includes people who already have a licence under the old Auctioneers Act 1928, and their business partners whose names are on that licence.

The new Act applies to these people, but there are some special rules. Their automatic registration only lasts for 6 months after the new Act starts. After that, they need to register properly under the new Act.

As soon as the new Act begins, all the old licences from the Auctioneers Act 1928 stop working. They are replaced by the new registration system.

The person in charge of the register (called the Registrar) doesn’t have to put the names and details of these automatically registered auctioneers on the new register right away. The Registrar only needs to add their information if they register properly under the new Act.

26Application of Act to existing licence holders and others

  1. After the commencement of this Act, the following persons are deemed to have been registered as auctioneers under this Act on the day on which this Act comes into force:

  2. every person who carries on business as an auctioneer and who, immediately before the commencement of this Act, holds a licence issued under the Auctioneers Act 1928 that has not expired:
    1. every person who is in partnership with a person referred to in paragraph (a) and whose name is endorsed on the licence.
      1. This Act applies to every person who is deemed to be a registered auctioneer, except as provided in this section.

      2. The registration of a person who is deemed to be registered by virtue of subsection (1) expires 6 months after the date on which this Act comes into force.

      3. Despite anything in the Auctioneers Act 1928, every licence issued under that Act that is in force immediately before the commencement of this Act expires on the date on which this Act comes into force.

      4. The Registrar is not obliged to ensure that the names and other details of people to whom this section applies are entered onto the register of auctioneers, unless or until they are registered in accordance with this Act.
