14: Transfer of requests

If you make a request for official information to a department or Minister, and they think another department or organisation has the information you want, they will send your request to that other department or organisation. They must do this within 10 working days of getting your request. They will also tell you that they have sent your request to another department or organisation.

If the information you want is not held by the department you asked, but they think another department or organisation has it, they will send your request to that other department or organisation. This can also happen if the department you asked thinks the information is more closely connected to another department or organisation. In both cases, the department you asked will send your request to the other department or organisation within 10 working days and inform you about it.

You made your request under section 12, which is a part of the law that says how you can ask for official information. When the department sends your request to another department or organisation, they will make sure you know what is happening with your request.

14Transfer of requests

  1. Where—

  2. a request in accordance with section 12 is made to a department or interdepartmental venture or Minister of the Crown or organisation; and
    1. the information, or some of the information, to which the request relates—
      1. is not held by the department or venture or Minister of the Crown or organisation but is believed by the person dealing with the request to be held by another department (for itself and for a departmental agency hosted by it or an interdepartmental executive board serviced by it) or interdepartmental venture or Minister of the Crown or organisation, or by a local authority; or
        1. is believed by the person dealing with the request to be more closely connected with the functions of another department (for itself and for a departmental agency hosted by it or an interdepartmental executive board serviced by it) or interdepartmental venture or Minister of the Crown or organisation, or of a local authority,—
        2. the department or venture or Minister of the Crown or organisation to which the request is made shall promptly, and in any case not later than 10 working days after the day on which the request is received, transfer the request, or relevant part of the request, to the other department or interdepartmental venture or Minister of the Crown or organisation, or to that local authority, and inform the person making the request accordingly.
