The same applies if the Attorney-General says that sharing some information would make it harder to prevent or investigate crimes. In these cases, the Ombudsman can suggest that the relevant department or Minister think about sharing the information again.

31Disclosure of certain information not to be recommended

  1. Where—

  2. the Prime Minister certifies that the making available of any information would be likely to prejudice—
    1. the security or defence of New Zealand or the international relations of the Government of New Zealand; or
      1. any interest protected by section 7; or
      2. the Attorney-General certifies that the making available of any information would be likely to prejudice the prevention, investigation, or detection of offences—
        1. an Ombudsman shall not recommend that the information be made available, but may recommend that the making available of the information be given further consideration by the appropriate department or interdepartmental venture or Minister of the Crown or organisation.
