53: Expiration of provisions relating to Information Authority

From 30 June 1988, some parts of the Official Information Act will no longer apply. You will not see the term Authority defined in the Act anymore, as the definition in section 2(1) will expire. The Act will also change in other ways.

Some parts of the Act, like Part 6, section 47, and Schedule 2, will no longer be part of the law. The words "or the Authority" will be removed from section 11(1)(a). The Authority will be dissolved, which means it will no longer exist.

When the Authority is dissolved, its property will belong to the Crown. Any money owed to the Authority will be owed to the Crown instead. The Crown will also take over any responsibilities or debts the Authority had. If there are any ongoing court cases involving the Authority, the Crown will take its place.

53Expiration of provisions relating to Information Authority

  1. As from the close of 30 June 1988—

  2. the following provisions of this Act, namely,—shall expire; and
    1. the definition of the term Authority in section 2(1); and
      1. Part 6; and
        1. paragraph (a) of section 47; and
          1. Schedule 2,—
          2. section 11(1)(a) shall be amended by omitting the words or the Authority; and
            1. the Authority shall be dissolved; and
              1. all real and personal property belonging to the Authority shall become vested in the Crown; and
                1. all money payable to the Authority shall become payable to the Crown; and
                  1. all liabilities, contracts, and engagements, and all rights and authorities of any nature whatever of the Authority shall become liabilities, contracts, engagements, rights, and authorities of the Crown; and
                    1. all proceedings pending by or against the Authority may be carried on, completed, or enforced by or against the Crown.
