When you apply for a means assessment, the date of the assessment is the date your application is received. If you ask for a review of your means assessment under section 47(a), the date of the review is the date your application for the review is received. The date of the review can be different depending on the type of review you are having, such as a review under section 47(b), section 47(c), section 48, or section 49.

If you are having a review under section 49, the date of the review might be the date of a general adjustment of benefits or allowances, the date advice was received under section 43(1), or the date the review was started. You can find more information about the different types of reviews in the Schedule 2 of this Act. The date of the means assessment is an important date that is used to work out your means assessment.

52Date of means assessment

  1. In this Act and Schedule 2, date of means assessment means,—

  2. in the case of a first means assessment conducted under this Act, the date on which the application for the means assessment is received:
    1. in the case of a review of a means assessment for which the person has applied under section 47(a), the date on which the application for the review is received:
      1. in the case of a review under section 47(b), the date of means assessment that applied to the earlier, apparently mistaken, means assessment:
        1. in the case of a review under section 47(c), the date, determined by MSD, on which the person’s circumstances changed:
          1. in the case of a review under section 48, the date on which MSD initiated the review:
            1. in the case of a review under section 49
              1. conducted by MSD in the event of a general adjustment of rates of benefits or allowances, the date of that general adjustment; or
                1. conducted as a result of advice received by MSD under section 43(1), the date on which that advice was received; or
                  1. conducted by MSD in any other case, the date on which MSD initiated the review.
