Residential Care and Disability Support Services Act 2018
Special case persons - Exempt persons
23: Who is exempt person
You could also call this:
"Who doesn't have to follow all the rules about paying for care and support services"
You are an exempt person if you meet certain conditions. You must be funding eligible, which means you have the money to pay for care. You must also have been positively needs assessed, which means someone has checked that you need care.
You must receive contracted care services, which are services that have been agreed to by a care provider. You must also belong to a class of exempt persons, which is a group of people defined in regulations made under section 74.
This means that to be an exempt person, you need to meet all of these conditions.
