You cannot be found guilty of an offence under section 44 if the court thinks the rule was broken in a way that does not matter to the case. You also cannot be found guilty if the court thinks the rule was broken, but it was reasonable to make the mistake. The court will decide if the mistake was reasonable by looking at all the circumstances of the case. If you are a director of a company, you cannot be found guilty of an offence under section 44 if the company broke the rule without you knowing or agreeing to it. The court will look at what happened and decide if you should be found guilty. If you are accused of breaking the rules under section 44, you have to prove that you did not break the rules on purpose or that it was a reasonable mistake. You have to show the court that you are not guilty of the offence.
