The Governor-General can change the schedules in the act from time to time. You can think of schedules like lists of items. The Governor-General can add or remove items from Schedule 1, Schedule 2, or Schedule 3, or change items that are already there.

The Governor-General can also add or remove parts from these schedules, or get rid of a whole schedule and replace it with a new one. This is done so the schedules match the Convention, which can be changed from time to time.

When the Governor-General makes an order to change the schedules, it is considered secondary legislation, which has its own rules for publication, as explained in Part 3 of the Legislation Act 2019.

53Schedules

  1. The Governor-General may from time to time, by Order in Council,—

  2. add any item to, omit any item from, or amend any item in Schedule 1 or Schedule 2 or Schedule 3:
    1. add any Part to, or omit any Part from, Schedule 1 or Schedule 2 or Schedule 3:
      1. revoke any such schedule and substitute a new schedule—
        1. in order that those schedules may conform with the Convention as amended from time to time.

        2. An order under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
