If you trade in a specimen of an endangered species without the right permit or certificate from sections 13 to 16, you are doing something wrong. You also do something wrong if you trade in a specimen of a threatened species without the right permit or certificate from sections 17 to 20, or a specimen of an exploited species without the right permit or certificate from sections 21 to 24.

If you have a specimen of an endangered, threatened, or exploited species that was brought into New Zealand from the sea in a way that does not follow this Act, you are doing something wrong. You are also doing something wrong if you do not follow the conditions of a permit or certificate given to you under Part 1.

If you do any of these things, you commit what is called an infringement offence.

50AInfringement offences

  1. A person must not—

  2. trade in any specimen of an endangered species without the appropriate permit or certificate granted under any of sections 13 to 16; or
    1. trade in any specimen of a threatened species without the appropriate permit or certificate granted under any of sections 17 to 20; or
      1. trade in any specimen of an exploited species without the appropriate permit or certificate granted under any of sections 21 to 24; or
        1. possess, or have under the person’s control although under the custody of another person, any specimen of an endangered, threatened, or exploited species that has been imported or introduced from the sea into New Zealand otherwise than in accordance with this Act; or
          1. fail to comply with any of the conditions specified by the Director-General in respect of any permit or certificate granted to the person under Part 1.
            1. A person who fails to comply with this section commits an infringement offence.
