39BForm and content of databank compulsion notice issued in relation to person under age of 18 years

  1. Every databank compulsion notice issued in relation to a person under the age of 18 years must be in the prescribed form.

  2. Every databank compulsion notice issued in relation to a person under the age of 18 years must contain the particulars listed in section 39A(2), or if applicable section 39A(3), as well as the following particulars:

  3. a statement that a bodily sample may not be taken unless all reasonable steps have been taken to serve a copy of the notice on a parent or other person having the care of that person; and
    1. a statement that a parent or other person having the care of that person may request a databank compulsion notice hearing under section 41(3); and
      1. a statement that a parent or other person having the care of the person may be present when the bodily sample is taken.
