56How fingerprick sample to be dealt with

  1. Subject to any regulations made under this Act, on the taking of a fingerprick sample pursuant to this Act, the person taking the sample shall—

  2. place the sample in a container, which shall be sealed as soon as practicable after the sample has dried; and
    1. ask the person from whom the sample is taken whether or not he or she wishes to have a second fingerprick sample taken for the purposes of having the sample analysed on his or her own behalf; and
      1. if the person responds in the affirmative, take a second fingerprick sample from the person, but only with that person’s consent; and
        1. deliver any second fingerprick sample—
          1. immediately to that person; or
            1. if the person from whom the fingerprick sample is taken is in custody (other than pursuant to a warrant issued under section 45),—
              1. as soon as is practicable to any person nominated by that person for the purpose if the nominated person is not present when the fingerprick sample is taken; or
                1. immediately to any person nominated for the purpose if the nominated person is present when the fingerprick sample is taken.
