38Functions of Tribunal

  1. The functions of the Tribunal are to—

  2. do all things necessary to comply with and implement the anti-doping rules and integrity codes; and
    1. determine disputes arising from the application of an integrity code; and
      1. hear an appeal against a decision of a disciplinary panel under subpart 4 of Part 4 of the Integrity Sport and Recreation Act 2023; and
        1. hear an appeal against a decision of a disciplinary body established by an organisation that has adopted an integrity code; and
          1. subject to any other enactment, determine sports-related disputes if—
            1. all parties to the dispute agree in writing to refer the dispute to the Tribunal; and
              1. the Tribunal agrees, at its sole discretion, to hear and determine the dispute; and
              2. subject to any other enactment, hear an appeal against a decision of a national sporting organisation or the New Zealand Olympic Committee Incorporated if the constitution, rules, or regulations of that body specifically provide for an appeal to the Tribunal in relation to that matter; and
                1. consider any matter referred to it by the board of Sport and Recreation New Zealand or the Integrity Sport and Recreation Commission; and
                  1. generally take all steps necessary or desirable to achieve the purposes of this Act; and
                    1. exercise and perform any other functions, powers, and duties that—
                      1. are conferred or imposed on the Tribunal by this or any other enactment; or
                        1. are conferred or imposed on the Tribunal by the Minister.
