1Reappointment of some existing Referees

  1. For the purpose of this clause, commencement date means the date on which section 33(1) of the Tribunals Powers and Procedures Legislation Act 2018 comes into force.

  2. A person who holds the position of Referee immediately before the commencement date and who does not meet the qualification requirement in section 7(2)(a) may be reappointed as a Referee under section 7 if he or she meets the requirements of section 7(2)(b) and (c).

2Remuneration of Principal Disputes Referee and Referees

  1. A person who immediately before the commencement date held office as the Principal Disputes Referee or a Referee continues to be paid the same amount of remuneration and allowances that applied to that office immediately before that date, until new remuneration and allowances are determined by the Remuneration Authority under section 9(1)(a).

  2. In this clause,—

    commencement date means the date on which the Remuneration Authority Legislation Act 2022 comes into force

      Principal Disputes Referee includes a person appointed as an Acting Principal Disputes Referee under section 6B.

      3Provisions relating to Disputes Tribunal Amendment Act 2025

      3Jurisdictional limit of claims made before commencement date

      1. This clause applies to a person who, before the commencement date,—

      2. makes a claim under this Act; and
        1. abandons under section 14 so much of the claim as exceeds $30,000 in order to bring the claim within the jurisdiction of the Tribunal.
          1. If the claim has not been disposed of before the commencement date, the person may not, on or after the commencement date,—

          2. amend the claim to include any of the amount of the claim that the person abandoned under section 14; or
            1. withdraw, or ask the Disputes Tribunal to strike out, the claim in order to make a new claim seeking—
              1. the amount originally claimed; and
                1. the amount, in whole or in part, that the person had abandoned under section 14.
                2. In this clause, commencement date means the date on which this clause comes into force.
