27Special powers to call for information or documents

1. If the conditions stated in subsection (2) are satisfied, the Commissioner may, by notice in writing, require any person—

2. to provide the Commissioner, or a specified employee of the Commissioner, with any information that the Commissioner requires; or
3. to produce to the Commissioner, or to a specified employee of the Commissioner, any document in the custody or under the control of that person, and to allow copies of, or extracts from, the document to be made or taken; or
4. to provide the Commissioner, or a specified employee of the Commissioner, with copies or extracts from documents in the custody or under the control of that person.

5. The conditions are that—

6. the Commissioner believes, on reasonable grounds, that the exercise of the powers conferred by subsection (1) is necessary to enable it to carry out an inquiry; and
7. the Commissioner believes, on reasonable grounds, that—
   1. it is not reasonably practicable to obtain the information or document from another source; or
   2. for the purposes of the inquiry, it is necessary to obtain the information or document to verify or refute information obtained from another source.

8. However, the Commissioner must not require any personal information to be provided under this section unless that information can be provided in a form in which—

9. personal identifiers (for example, name or address) have been removed; and
10. the individual concerned cannot otherwise reasonably be identified.
