If you publish a referendum advertisement before and during a special time called the regulated period, this rule applies to you. You might publish the advertisement before the regulated period starts and keep it going during that time, or you might publish it both before and during the regulated period.

When this rule applies, the advertisement is treated as if it was published during the regulated period, but you only count the expenses that are fair to attribute to that time.

You only count the expenses that happen during the regulated period for certain other rules, like sections 44(b), 45, and 72, and you figure out what those expenses are based on the rule in subsection (2).
