Illustration for Referendums Framework Bill

The Electoral Commission has a job to do if they think someone has broken a rule in this proposed law. You need to know that if they believe someone has done something wrong, they must tell the New Zealand Police what they know. They have to share the facts that made them think someone broke the rule. However, if the Electoral Commission thinks the wrongdoing is very minor and not important to the public, they do not have to tell the Police.

Part 4Miscellaneous provisions

84Duty of Electoral Commission

  1. If the Electoral Commission believes that a person has committed an offence under this Act, the Electoral Commission must report the facts on which that belief is based to the New Zealand Police.

  2. However, subsection (1) does not apply to an offence if the Electoral Commission considers that the offence is so inconsequential that there is no public interest in reporting those facts to the New Zealand Police.
