Bail: Other provisions relating to bail

52Procedure for bail generally

  1. If an application for bail is made under section 49(3) or 50(3), the Registrar must forward a copy of the application to the Director of Military Prosecutions.

  2. The Director of Military Prosecutions—

  3. must be the respondent to the application; and
    1. may make recommendations to the Judge who is considering the application.
      1. Before making a decision, the Judge must consider any recommendations that the Director of Military Prosecutions has made, including any recommendations on measures to prevent the escape of the person concerned should bail be granted.
