If you are found guilty of a charge that has alternative charges, the Court Martial must find you not guilty of any alternative charges that come before it on the charge sheet. The court must also not make a decision on any alternative charges that come after the charge you were found guilty of on the charge sheet. This means the court will only deal with the charge you were found guilty of and the alternative charges that come before it.

  1. If the Court Martial records a conviction on a charge laid in the alternative, the court must—

  2. find the accused not guilty of any charge laid in the alternative to it that is placed before it on the charge sheet; and
    1. record no finding on any alternative to it that is placed after it on the charge sheet.
