37Stock to be delivered up on payment of expenses before impounding

  1. Where stock has been seized by any person for impounding under section 33, and, before the stock has been actually impounded, the owner of the stock or any person on his behalf pays or tenders to the person in charge of the stock the driving charges that would have been payable if the stock had been impounded in the nearest accessible pound, together with the amount of any expenses incurred under subsection (3) of section 33, that person shall forthwith deliver up the stock to the owner or to the person so paying or tendering on his behalf: provided that no such delivery shall exempt any person from any penalty for which he is liable under the said section 33.
