15A: Registrar may change name

If you’re part of a board registered under the Charitable Trusts Act 1957, the Registrar can change your board’s name if it doesn’t follow the rules set out in section 15. The Registrar will choose a new name that does follow the rules.

Before changing the name, the Registrar will give your board a chance to pick a new name. You and the other board members can vote on a new name at a meeting. If you don’t choose a new name, the Registrar will pick one for you.

When the Registrar changes your board’s name, they will give you a new certificate that shows the new name. This certificate proves that your board’s name has been officially changed.

15ARegistrar may change name

  1. If the Registrar is satisfied that the name under which a board is registered is not permitted under section 15, the Registrar may enter a new name on the register for the board that would be permitted under section 15 in place of the former name.

  2. The name entered on the register under subsection (1) may be a name selected by the board after being given a reasonable opportunity to do so (pursuant to a resolution passed at a meeting of the board), or if the board does not select a name, a name selected by the Registrar.

  3. If the Registrar registers a new name, the Registrar must issue a certificate of incorporation recording the change of name.
