When the Commissioner finishes an investigation, they must tell you the results as soon as they can. They have to tell you what they found out and what they plan to do next, or if they are not going to do anything else. You will be told this if you made a complaint that led to the investigation.

The Commissioner also has to tell the person who was affected by what happened, and the health care or disability services provider who was investigated. If the investigation was about a health practitioner, the Commissioner must tell the authority that is in charge of that practitioner. The Commissioner must give them information about the results of the investigation and any further action they plan to take.

The Commissioner has to do this as soon as it is reasonably possible after they finish the investigation.

43Information about result of investigation

  1. As soon as reasonably practicable after the Commissioner completes an investigation, the Commissioner must advise the persons specified in subsection (2)—

  2. of the results of the investigation; and
    1. of any further action that the Commissioner proposes to take or that the Commissioner proposes to take no further action.
      1. The persons referred to in subsection (1) are—

      2. any complainant whose complaint led to the investigation:
        1. any person alleged to be aggrieved (if not the complainant):
          1. the health care provider or the disability services provider whose action was the subject of the investigation:
            1. if the investigation directly concerns a health practitioner, the appropriate authority.
