The Commissioner is a person who helps make sure health and disability services are good. You might wonder who can do the Commissioner's job if they are not available. The Commissioner can give some of their tasks to a Deputy Commissioner. The Commissioner cannot give certain tasks to just anyone, like tasks under Part 2 of this Act. The Commissioner also cannot give tasks like designating people under section 15(1) or section 24(1) to just anyone.

68Delegation of functions and powers

  1. Repealed
  2. The Commissioner may not delegate to any person other than a Deputy Commissioner

    1. the functions of the Commissioner under Part 2; or
      1. the power to designate any person under section 15(1) or section 24(1), or to revoke any such designation; or
        1. the power to make any recommendation or report under this Act.
          1. The Commissioner may not delegate the functions or powers of the Commissioner under Part 4 or section 61 to the Director of Proceedings.

          2. In other respects, the Commissioner may delegate in accordance with section 73 of the Crown Entities Act 2004.

          3. The Director of Proceedings may from time to time, with the prior approval of the Commissioner in each case, delegate to any person holding office under the Commissioner all or any of the functions and powers of the Director of Proceedings under this Act or any other Act.

          4. The Director of Advocacy may from time to time, with the prior approval of the Commissioner in each case, delegate to any person holding office under the Commissioner all or any of the functions and powers of the Director of Advocacy under this Act or any other Act.

          5. No delegation under subsection (4) shall be to the Director of Advocacy.

          6. No delegation under subsection (5) shall be to the Director of Proceedings.

          7. Sections 62 to 72 of the Crown Entities Act 2004 apply to a delegate under subsection (4) or (5) as if the delegate were a member and as if the disclosure must be made to the Commissioner and with other necessary modifications.

          8. Sections 74 to 76 of the Crown Entities Act 2004 do not apply to a delegation under subsection (4) or (5).
