In the Children's Act 2014, a specified organisation is one that employs or engages a children's worker to perform a regulated service. You are part of a specified organisation if you work for the State services, or if your organisation is funded by the State services to provide these services.

A specified organisation can also be a local authority, or an individual or organisation funded by a local authority to provide regulated services, but only after a certain date.

There is another type of specified organisation, which is a sponsor as defined in section 10(1) of the Education and Training Act 2020.

However, some individuals or organisations are not considered specified organisations, even if they seem like they should be, if regulations made under section 33(1)(c) say they are not.

You are not a specified organisation if you are a parent or guardian of a child and you receive funding to get regulated services for that child. You are also not a specified organisation if you do not receive funding from a specified organisation to provide regulated services, but you are paid by a parent to provide those services.

24Specified organisation defined

  1. In this Part, specified organisation means any of the following that employs or engages a children's worker to perform a regulated service:

  2. any of the State services:
    1. an individual or organisation that is funded (whether wholly or partly and whether directly or indirectly) by a State service to provide regulated services:
      1. on and after the date that is 2 years after the date on which this Part comes into force (or any earlier date specified in regulations made under section 33(1)(b)),—
        1. local authorities; and
          1. individuals and organisations that are funded (whether wholly or partly and whether directly or indirectly) by a local authority to provide regulated services:
          2. a sponsor as defined in section 10(1) of the Education and Training Act 2020.
            1. Despite subsection (1), an individual or organisation is not a specified organisation if it is declared by regulations made under section 33(1)(c) not to be a specified organisation for the purposes of this Part.

            2. Despite subsection (1), the following are not specified organisations:

            3. an individual (person A) who, in relation to a child (child A),—
              1. is a parent or guardian, or has the care, of child A; and
                1. receives funding (directly or indirectly) from a specified organisation for the purpose of securing the provision of particular regulated services to child A:
                2. an organisation that does not (except as provided in subparagraph (i) or (ii)) receive funding, directly or indirectly, from a specified organisation to provide specified regulated services, but—
                  1. is paid by person A to provide some or all of the particular regulated services to child A; or
                    1. receives funding, pursuant to an entitlement of person A, to provide some or all of the particular regulated services to child A.
