When you are part of a disciplinary panel, you can ask for information from the people involved or from others to help you make a decision about a matter described in section 41(1). You can also interview the people involved to get more information. You can ask people to tell you things and you can talk to them to understand what happened. When you have all the information you need, you can decide what to do next.

You can choose to do nothing, send the matter back to the organisation to look into it more, or tell the organisation what action to take. If you think an organisation should take action, you can tell them what to do based on their rules. You have to follow the rules that are set out for you in the integrity code.

You must do what the integrity code says you should do when you are making decisions.

42Powers and procedure of disciplinary panel

  1. A disciplinary panel may, for the purpose of considering and determining a matter described in section 41(1),—

  2. request information from the parties or from any other person:
    1. interview any of the parties.
      1. Having considered the matter, a disciplinary panel may—

      2. recommend that no further action be taken:
        1. refer the matter back to the Commission or the organisation concerned for further investigation, determination of a sanction under the integrity code, or any other action:
          1. require an organisation to impose a sanction specified by the panel from those available under the relevant integrity code or the organisation’s policies made under the integrity code.
            1. The disciplinary panel must comply with the procedure prescribed for the panel in the relevant integrity code.
