225: Rights and privileges under other enactments or common law

This Act does not change any rights or privileges you have under other laws. You still have the same rights as you did before under other laws or common law. The Crown and the House of Representatives also keep their existing rights. This Act is the main law about copyright in New Zealand. It means you can only have copyright rights under this Act or other laws that talk about copyright. You cannot have copyright rights outside of these laws. The Act does not affect rules that stop people enforcing copyright if it is not in the public interest. It also does not change any other legal actions you can take if someone infringes on your rights under Part 4 of this Act, which you can read more about by following the link to Part 4. You can still take other legal actions if someone breaks the law in relation to your copyright rights.

225Rights and privileges under other enactments or common law

  1. Nothing in this Act affects—

  2. any right or privilege of any person under any other enactment:
    1. any right or privilege of the Crown existing otherwise than under an enactment:
      1. any right or privilege of the House of Representatives:
        1. the right of the Crown or any person deriving title from the Crown to sell, use, or otherwise deal with objects forfeited under the laws relating to customs and excise:
          1. the operation of any rule of equity relating to breaches of trust or confidence.
            1. Subject to subsection (1), no copyright or right in the nature of copyright shall exist otherwise than under this Act or some other enactment in that behalf.

            2. Nothing in this Act affects any rule of law preventing or restricting the enforcement of copyright, on grounds of public interest or otherwise.

            3. Nothing in this Act affects any right of action or other remedy, whether civil or criminal, available otherwise than under this Act in respect of acts infringing any of the rights conferred by Part 4.
