216: Witness summons

You can be asked to go to the Tribunal to give evidence. The Tribunal can ask you to come, or someone involved in the case can ask them to ask you. You will get a witness summons that tells you where and when to go. You will be told what to bring with you, like papers or documents. You will also be told you can get money for travelling and other expenses. The summons will say what might happen if you do not go to the Tribunal. The Tribunal, the chairperson, or an officer can send you a witness summons. They can do this on their own or because someone asked them to, and they must follow the rules, as seen in similar laws, such as s 109.

216Witness summons

  1. The Tribunal may of its own motion, or on the application of any party to the proceedings, issue a witness summons to any person requiring that person to attend before the Tribunal to give evidence at the hearing of the proceedings.

  2. The witness summons shall state—

  3. the place where the person is to attend; and
    1. the date and time when the person is to attend; and
      1. the papers, documents, records, or things that that person is required to bring and produce to the Tribunal; and
        1. the entitlement to be tendered or paid a sum in respect of allowances and travelling expenses; and
          1. the penalty for failing to attend.
            1. The power to issue a witness summons may be exercised by the Tribunal or the chairperson, or by any officer of the Tribunal purporting to act by the direction or with the authority of the Tribunal or the chairperson.
