You can make a copy of a work in a format that is accessible to people with print disabilities if you notify the copyright owner and make the copy only for people with print disabilities or other authorised entities. You must also ensure the copy does not change the original work too much. You can import an accessible copy from another authorised entity in a Marrakesh Treaty country if you follow similar rules. You can export accessible copies to other countries or reproduce and provide them to people with print disabilities or other authorised entities in New Zealand. You can also share accessible copies with people in New Zealand who have print disabilities or with other authorised entities, as long as you follow the rules and respect the original work. This includes exporting copies to section 69B(2)(c) or providing them to people with print disabilities. You must always try to keep the original work intact when making accessible copies.

69AAccessible format copy activities by authorised entity

  1. An authorised entity does not infringe copyright in the relevant work if the entity acts in accordance with this section.

  2. An authorised entity may make an accessible format copy if the entity—

  3. has taken all reasonable steps to notify the owner of the copyright in the work of its intention to make an accessible format copy; and
    1. is making the copy to provide it only to persons who have a print disability, persons acting on their behalf, or other authorised entities; and
      1. ensures that the copy respects the integrity of the original work, as far as is reasonably possible and taking into account changes needed to make the work accessible in the alternative format.
        1. An authorised entity (A) may import into New Zealand an accessible format copy from an authorised entity (B) in another Marrakesh Treaty country if A—

        2. has taken all reasonable steps to notify the owner of the copyright in the work of its intention to make an accessible format copy; and
          1. is importing the copy to provide it only to persons who have a print disability, persons acting on their behalf, or other authorised entities; and
            1. has taken all reasonable steps to ensure that the copy respects the integrity of the original work, as far as is reasonably possible and taking into account changes needed to make the work accessible in the alternative format.
              1. An authorised entity may do 1 or more of the following:

              2. export from New Zealand an accessible format copy to an authorised entity, or a person who has a print disability, in another Marrakesh Treaty country:
                1. reproduce copies—
                  1. made or imported into New Zealand under this section; or
                    1. provided to the entity under section 69B(2)(c):
                    2. provide, by communication or otherwise, accessible format copies made or imported under this section or provided to the entity under section 69B(2)(c) to—
                      1. persons in New Zealand who have a print disability or persons acting on their behalf; and
                        1. other authorised entities in New Zealand.
