177Things done for purposes of instruction or examination
The rights conferred by subparts 2 to 4 are not infringed by the copying of a recording of a performance if—
- the copying is done—where the lesson is on how to make films or film soundtracks or relates to the learning of a language or is conducted by correspondence; and
- in the course of preparation for instruction; or
- for use in the course of instruction; or
- in the course of instruction; or
- after the course of instruction—
- in the course of preparation for instruction; or
- the copying is done by or on behalf of a person who is to give, is giving, or has given the lesson or by or on behalf of a person who is to receive, is receiving, or has received the lesson; and
- no charge is made for the supply of a copy to any student or other person who is to receive, is receiving, or has received the lesson.
The rights conferred by subparts 2 to 4 are not infringed—
- by the copying of a recording of a performance for the purposes of setting or answering the questions in an examination; or
- by anything done for the purposes of an examination by way of communicating the questions to the candidates.
