Illustration for Inspector-General of Defence Act 2023

You have a Deputy Inspector-General who helps the Inspector-General. The Deputy Inspector-General can do all the things the Inspector-General can do. They can do these things in the same way as the Inspector-General. When the law talks about the Inspector-General in sections like section 9 or 10, or in Parts 3 to 6, it also means the Deputy Inspector-General, unless it says otherwise. The Deputy Inspector-General is controlled by the Inspector-General, but not if the Inspector-General's job is empty or they are away from work. If the Deputy Inspector-General does something the Inspector-General can do, it is assumed they have the power to do it, unless proven otherwise.

Deputy Inspector-General of Defence

12Functions of Deputy Inspector-General

  1. The Deputy Inspector-General—

  2. has all the functions of the Inspector-General; and
    1. may perform those functions in the same manner, subject to the same restrictions, and with the same effect, as if they were performed by the Inspector-General.
      1. Accordingly, a reference to the Inspector-General in section 9 or 10 or any of Parts 3 to 6 includes a reference to the Deputy Inspector-General unless the context otherwise requires.

      2. However, the performance by the Deputy Inspector-General of the Inspector-General’s functions is subject to the control of the Inspector-General unless—

      3. the office of Inspector-General is vacant; or
        1. the Inspector-General is absent from duty.
          1. The fact that the Deputy Inspector-General performs a function of the Inspector-General is, in the absence of evidence to the contrary, conclusive evidence of the Deputy Inspector-General’s authority to do so.
