The Authority makes decisions about how much people get paid. You want to know how often they make these decisions. The Authority can make a new decision at any time.

19Frequency of adjustments

  1. This section applies to determinations other than those under section 12(1)(b) or section 12(1)(ba) or section 12B(2).

  2. Subject to subsection (4), every determination shall specify the date on which it expires and shall continue in force at least until the close of that date. The Authority may issue separate determinations, at different times, for the different positions under the jurisdiction of the Authority. The Authority may make a determination before or after the date upon which that determination is to come into force.

  3. No determination, or any part of it, shall come into force earlier than the date of the expiry of the currency of the existing determination being wholly or partially superseded by the first-mentioned determination.

  4. Notwithstanding the expiry of the currency of a determination, it shall continue in force to the extent that it is not superseded by another determination.

  5. Notwithstanding subsection (1), the Authority may at any time while a determination is in force amend that determination—

  6. for the purpose of remedying any defect or removing any ambiguity; or
    1. to deal with any new matter that was not dealt with at the time of the making of the determination; or
      1. if the Authority is satisfied that in all the circumstances there are particular and special reasons that justify a period of less than the term specified in the determination.
        1. Notwithstanding any term included in any determination, the Authority must review, and issue a determination for, each position that is subject to its jurisdiction,—

        2. in the case of the salaries and allowances of members of Parliament, as set out in subsections (6) to (8); and
          1. in any other case, at intervals of not more than 3 years.
            1. The Authority must begin a review of the salaries and allowances of members of Parliament within 3 months from the return of the writ after a general election, based on the information that is available to the Authority at the time of its review.

            2. After the review, the Authority must issue a determination that—

            3. is deemed to have come into force on the date of the day after polling day for that general election; and
              1. expires on polling day for the next general election; and
                1. specifies separately the salaries and allowances payable for each of the periods set out in subsection (8).
                  1. The determination under subsection (7) must set out the salaries and allowances of members of Parliament for the following periods:

                  2. the period beginning on the day after polling day and ending on the next 30 June; and
                    1. the period beginning on 1 July after the 30 June referred to in paragraph (a) and ending on the next 30 June; and
                      1. the period beginning on 1 July after the 30 June referred to in paragraph (b) and ending on the next 30 June; and
                        1. the period beginning on 1 July after the 30 June referred to in paragraph (c) and ending on polling day for the next general election.
