11: Guarantee as to price

When you buy something, there’s a guarantee about the price. You don’t have to pay more than a fair price for the goods. This applies when the price isn’t already set in your agreement with the seller, or when you haven’t agreed on how to decide the price, or when there’s no usual way you and the seller determine prices.

If you’re asked to pay more than a reasonable price, you have the right to refuse to pay the extra amount. You only need to pay what’s fair.

This guarantee doesn’t give you any other rights besides refusing to pay more than a fair price. There’s an exception to this rule, which you can find in section 41 of this law.

11Guarantee as to price

  1. Subject to section 41, where goods are supplied to a consumer there is a guarantee that the consumer is not liable to pay to the supplier more than a reasonable price for the goods in any case where the price for the goods is not—

  2. determined by the contract; nor
    1. left to be determined in a manner agreed by the contract; nor
      1. left to be determined by the course of dealing between the parties.
        1. Where there is a failure to comply with the guarantee in this section, the consumer's right of redress is to refuse to pay more than a reasonable price.

        2. Nothing in Part 2 confers any other right of redress.
