13: Express guarantees

“Promises made by product makers must be kept”

When someone sells you goods, this law applies to any promises the maker of the goods gives you. These promises are called express guarantees. They only count if they follow the rules in section 14.

If the goods don’t match what the maker promised, you have the right to ask the maker to fix the problem. The rules for how to do this are in Part 3 of this law.

13Express guarantees

  1. Where goods are supplied to a consumer, this Act applies to any express guarantee given by a manufacturer of the goods which is binding on the manufacturer in accordance with section 14.

  2. Part 3 gives the consumer a right of redress against the manufacturer where the goods fail to comply with any such guarantee.
