30: Guarantee as to time of completion

When someone provides a service to you, they must finish it in a reasonable amount of time. This is a guarantee you have as a consumer. However, this guarantee doesn’t apply if you and the service provider have already agreed on when the service will be finished. The agreement could be written in your contract, or you might have decided together how to set the time, or it could be based on how you’ve done business with each other before. If none of these apply, then the service should be completed within a reasonable time. There are some exceptions to this rule, which are explained in section 41 of the law.

30Guarantee as to time of completion

  1. Subject to section 41, where services are supplied to a consumer there is a guarantee that the service will be completed within a reasonable time in any case where the time for the service to be carried out is not—

  2. fixed by the contract; nor
    1. left to be fixed in a manner agreed by the contract; nor
      1. left to be determined by the course of dealing between the parties.
