The Minister has to check if the levy is working well. You will know the levy is working well if the amount of waste in New Zealand is decreasing. The Minister must do this check not later than 2 years after the levy starts and then every 3 years after that. When the Minister does the check, they have to get advice from the Waste Advisory Board and think about whether people in New Zealand are reusing, recycling, or recovering more waste than before. The Minister can also think about other things that they believe are important when checking if the levy is working well.

39Minister must review effectiveness of levy

  1. The Minister must review the effectiveness of the levy—

  2. not later than 2 years after the commencement of this Part; and
    1. then at intervals of not more than 3 years after the last review.
      1. In undertaking a review, the Minister—

      2. must obtain and consider the advice of the Waste Advisory Board; and
        1. must consider whether the amount of waste disposed of in New Zealand has decreased since the last review (or the commencement of this Part, in the case of the first review); and
          1. must consider whether the amount of waste reused, recycled, or recovered in New Zealand has increased since the last review (or the commencement of this Part, in the case of the first review); and
            1. may consider any other matters that he or she thinks relevant.
