34: Sharing information with other persons or bodies

The Registrar can share information with certain people or groups to help them do their jobs. This information is not on the public register. The Registrar can only share information if they think it will help the other person or group with their work.

The Registrar can also use information that these people or groups give them to do their own job better.

This rule applies even if other laws or agreements say something different.

The people and groups the Registrar can share information with include:

The Financial Markets Authority, the Reserve Bank of New Zealand, other licensing authorities listed in Schedule 2, the New Zealand Police, people who run approved dispute resolution schemes, the Commerce Commission, the disciplinary committee, and the person who manages New Zealand Business Numbers under the New Zealand Business Number Act 2016.

The Registrar can also share information with agencies that deal with money laundering or terrorism financing, if the government says it's okay. They can share information with similar overseas agencies too, but only if there's a written agreement between that agency and the Minister about how to share the information.

34Sharing information with other persons or bodies

  1. The Registrar may communicate to any of the persons or bodies referred to in subsection (4) any information that the Registrar—

  2. holds (other than on the register) in relation to the exercise of the Registrar’s powers or the performance of the Registrar’s functions and duties; and
    1. considers may assist the person or body in the exercise of its powers or the performance of its functions and duties.
      1. The Registrar may use any information communicated to the Registrar by a person or body referred to in subsection (4) in the Registrar’s exercise of the Registrar’s powers or the performance of the Registrar’s functions and duties.

      2. This section applies despite anything to the contrary in any enactment, contract, deed, or document.

      3. The persons or bodies to which this section applies are—

        1. the Reserve Bank of New Zealand:
          1. any other licensing authority identified in Schedule 2:
            1. the New Zealand Police:
              1. the person responsible for an approved dispute resolution scheme:

                    1. the Registrar of New Zealand Business Numbers appointed under the New Zealand Business Number Act 2016:
                      1. a prescribed agency that carries out supervisory or enforcement functions relating to money laundering or terrorist financing:
                        1. a prescribed overseas agency that is the equivalent of the Registrar or of a body referred to in paragraphs (a) to (c), but only where there is a written agreement between the overseas agency and the Minister about sharing the information.
