You are on active service if your part of the Armed Forces has an active service order. You are also on active service if your group is fighting the enemy or occupying a foreign country. You are on active service if you have an order saying so or if your group is already on active service. You stay on active service until you get an order saying you are not. This order is called an active service order. It tells you when you start or stop being on active service. If you are visiting a group that is on active service, you are also on active service. This is because you are with a group that is already fighting or occupying a country. You need an active service order to stop being on active service.

44Active service

  1. For the purposes of this Act, any part of the Armed Forces is on active service when—

  2. there is for the time being in force an active service order posting it for active service; or
    1. it is engaged in any operation against the enemy; or
      1. it is in armed occupation of any foreign country.
        1. For the purposes of this Act, every member of the Armed Forces is on active service when—

        2. there is for the time being in force an active service order posting that member for active service; or
          1. the part of the Armed Forces with which that member is serving or which that member is visiting is on active service.
            1. No person or part of the Armed Forces that is for the time being on active service shall cease to be on active service until the issue of an active service order to that effect.
