56Referrals of matters

  1. This section applies when—

  2. the Monitor is performing or exercising their functions, duties, or powers under this Act:
    1. an Ombudsman is performing or exercising their duties or powers under this Act or functions, duties, or powers under the Ombudsmen Act 1975.
      1. If the Monitor or an Ombudsman considers that the subject matter of an inquiry, review, investigation, complaint, or other function relates (whether in whole or in part) to a matter that is more properly within the scope of the functions of a person or body specified in subsection (5), the Monitor or the Ombudsman must, without delay, consult that person or body to determine the appropriate means of dealing with the subject matter.

      2. As soon as practicable after consulting the person or body, the Monitor or the Ombudsman must determine whether the subject matter should be dealt with, in whole or in part, under this Act.

      3. If the Monitor or the Ombudsman determines that the subject matter should be dealt with, in whole or in part, by one of the persons or bodies specified in subsection (5), the Monitor or the Ombudsman must, without delay,—

      4. refer the subject matter, or the appropriate part of the subject matter, to that person or body; and
        1. give written notice of the referral to the individual who initiated the inquiry, review, investigation, or complaint.

            1. the Children’s Commissioner:
              1. the Monitor:
                1. an Ombudsman exercising jurisdiction under the Ombudsmen Act 1975 or this Act:
