9: Application of Part to persons subject to term of imprisonment

This part of the law applies to you if you are in prison because you did not pay a fine or money you owed, or because you did not obey a court order, or because you showed contempt to the court. It treats you as if you were sentenced to prison, even if that is not exactly what happened. The law uses the words "sentence of imprisonment" and "offender" to describe people who are in prison, and it applies these words to you when you are subject to a term of imprisonment. If you are in prison for not paying a fine or money you owed, there are some extra rules that apply to you, which are found in section 19E of the Crimes Act 1961 and section 91(1) and (5) of the Summary Proceedings Act 1957. 9Application of Part to persons subject to term of imprisonment

  1. Unless specifically provided otherwise, this Part applies to every person who is subject to a term of imprisonment (whether by committal, sentence, or order) for non-payment of a fine or other sum of money, disobedience of a court order, or contempt of court, as if—

  2. every reference to a sentence of imprisonment included a reference to a term of imprisonment; and
    1. every reference to an offender included a reference to a person who is subject to a term of imprisonment.
      1. However, in relation to an offender who is subject to a term of imprisonment for non-payment of a fine or other sum of money, this Part is subject to section 19E of the Crimes Act 1961 and to section 91(1) and (5) of the Summary Proceedings Act 1957.
