When you get an extended supervision order, it starts on a certain date. If you are in prison, the order starts when you are released. If you already have an extended supervision order, the new one starts when the old one ends.

If you are released early under section 52, the conditions of your extended supervision order start on the day you are released. But the time limit on the order does not start until your official release date. Any standard release conditions you had before are cancelled when the extended supervision order starts.

Any special conditions you had before continue for three months after the extended supervision order starts. If someone asks the Board to change your conditions within those three months, the special conditions continue until the Board makes a decision. You can find more information about special conditions in section 107IA and section 15.

The extended supervision order ends on the earliest of these dates: when it is cancelled, when the time limit runs out, or when you get a new extended supervision order.

Nature of extended supervision order

107LCommencement and expiry of extended supervision order

  1. An extended supervision order comes into force,—

  2. if the order is made while the offender is detained under a sentence of imprisonment or liable to be recalled, on the offender's statutory release date; or
    1. if the order is in respect of an offender who is already subject to an extended supervision order, on the expiry of that order, unless an earlier date is specified in the new order; or
      1. in any other case,—
        1. on the date that the order is made; or
          1. if a different date is specified in the order, on the specified date.
          2. If an offender is released early under section 52 and the offender is subject to an extended supervision order made in the circumstances described in subsection (1)(a), then—

          3. the extended supervision conditions and any special conditions (including any special conditions imposed under section 107IA) come into force on the offender's actual release date; but
            1. time does not begin to run on the order until the offender's statutory release date.
              1. Any standard release conditions to which the offender is subject when the extended supervision order comes into force are discharged.

              2. Any special conditions (including any special conditions imposed under section 107IA) to which the offender is subject when an extended supervision order comes into force continue in force—

              3. until the date that is 3 months after the date on which the extended supervision order comes into force; or
                1. if an application is made to the Board seeking the imposition of special conditions under section 107K within that 3-month period, until the Board—
                  1. imposes 1 or more of those conditions; or
                    1. imposes any other special condition that the Board is entitled to impose under section 15; or
                      1. declines to impose any special conditions.
                      2. An extended supervision order expires on the earliest of the following:

                      3. the date on which the order is cancelled:
                        1. the date on which the term of the order expires:
                          1. if the offender becomes subject to a new extended supervision order before the expiry of an earlier extended supervision order, the commencement of the new extended supervision order.
