If you have an extended supervision order, you or a probation officer can ask the Board to change or cancel any of the conditions. The Board can consider your request at any time, even before the order starts. However, the Board cannot change any conditions in a way that goes against an order made under section 107IAC.

When the Board considers changing the conditions, they follow the same rules as they do for release conditions. This means they treat you as if you are already subject to the conditions. The Board looks at sections 56, 57, and 58(1) and (4) to decide what to do.

If the Board changes or cancels any conditions, they must tell you, the probation officer, the Police, and any victims of your offence about the changes. But the Board might not tell everyone about a particular condition if it would interfere with someone else's privacy.

107OBoard may vary conditions of extended supervision order

  1. At any time, whether before or after an extended supervision order has come into force, the offender who is subject to the order, or a probation officer, may apply to the Board for the variation or discharge of any condition of the order.

  2. However, the Board may not vary any condition of an extended supervision order in a way that would be contrary to any order made under section 107IAC requiring the imposition of an intensive monitoring condition.

  3. Sections 56, 57, and 58(1) and (4) apply as if the conditions of the extended supervision order were release conditions, and as if the offender were already subject to the conditions.

  4. If the conditions of an extended supervision order are varied or discharged, notice of the conditions as so varied or discharged must be provided to the following:

      1. the Police:
        1. every victim of the offender; but the Board may withhold notice of a particular condition if disclosure of the condition would unduly interfere with the privacy of any other person (other than the offender).
