To work out when you will be released from prison for good, the law looks at your sentence. If you were sentenced before a certain date, your final release date is determined under section 91 of the Criminal Justice Act 1985. This date can be changed according to section 106 of the Parole Act.

If your final release date is changed, it might need to be changed again if something is found to be wrong with the original date. This could happen if your sentence is cancelled or if someone made a mistake when working out your release date.

The law that works out your final release date is based on the Criminal Justice Act 1985, and if your date needs to be changed again, section 106 of the Parole Act will be used.

105Calculation of final release dates

  1. The final release date of an offender who is subject to a pre-cd sentence must be determined under section 91 of the Criminal Justice Act 1985, but any date so determined may be varied in accordance with section 106.

  2. If, after a final release date has been varied in accordance with section 106, it appears that the original date determined under the Criminal Justice Act 1985 should be amended (for instance, because a sentence is quashed, or an error in the determination is discovered), then the original determination may be amended and, if necessary, section 106 applies to the amended determination.
